SBA Prequalification: A business is deemed “SBA Prequalified” only after a preliminary review of its apparent SBA eligibility and historical cash flow ratios. Credit, collateral, and final approval remain subject to lender underwriting. This is not a commitment to lend. LoanBud is not affiliated with the SBA or any government agency. Programs, rates, terms, and conditions are subject to change without notice.
1. Acceptance of these Terms By accessing or using LoanBud.io (the “Site”) you agree to be bound by these Terms and Conditions (“Terms”) and our Privacy Policy. If you do not agree, do not use the Site.
2. Who We Are LoanBud (“LoanBud,” “we,” “our,” or “us”) is an online SBA loan marketplace that introduces small business buyers, sellers, and lenders. LoanBud is not a lender, loan broker, or government agency, and is not affiliated with the U.S. Small Business Administration (SBA).
3. What “SBA Prequalified” Means
- To be labeled “SBA Prequalified,” a business listing has been reviewed solely for:
- (a) apparent SBA program eligibility under the then-current SBA 7(a) Standard Operating Procedures (SOP); and
- (b) historical financials showing a debt-service-coverage ratio (DSCR) that generally meets underwriting guidelines used by lenders in our network.
- Limitations
- The review relies on information supplied by the seller and/or its advisers; LoanBud does not independently verify that information.
- Prequalification is not a credit decision, loan approval, or commitment to lend by LoanBud or any lender.
- Actual loan approval remains subject to each participating lender’s full credit, collateral, legal, and compliance review.
- Programs, rates, fees, and underwriting criteria may change without notice. An SBA Prequalification may be withdrawn, amended, or made subject to additional conditions at any time.
4. No Professional or Legal Advice Content on the Site is for general informational purposes only and should not be interpreted as legal, accounting, or other professional advice. You should consult your own advisers before acting on any information provided.
5. User Eligibility and Responsibilities
You represent that:
- All information you provide is accurate, complete, and not misleading
- You have authority to act on behalf of any business you list or represent
- You will use the Site only for lawful purposes and in compliance with these Terms.
6. Intellectual Property The Site, logo, content, and underlying technology are owned by LoanBud or its licensors and are protected by intellectual property laws. Except for the limited right to view content through a standard web browser, no license or right is granted.
7. Third-Party Links & Integrations The Site may link to or integrate with third-party websites, tools, or services. LoanBud does not control and is not responsible for them. Use at your own risk.
8. Disclaimer of Warranties The Site and all content are provided “as is” and “as available.” LoanBud disclaims all warranties, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability To the maximum extent permitted by law, LoanBud and its officers, directors, employees, or agents will not be liable for any direct, indirect, incidental, consequential, punitive, or special damages arising out of or connected with your use of (or inability to use) the Site, including reliance on any prequalification, even if advised of the possibility of such damages.
10. Indemnification You agree to indemnify, defend, and hold harmless LoanBud from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to
- (a) your breach of these Terms;
- (b) your misuse of the Site; or
- (c) your violation of any law or the rights of a third party.
11. Changes to the Site or Terms We may modify the Site, suspend access, or change these Terms at any time. Material changes will be posted on this page with a new “Last updated” date. Your continued use after changes are posted constitutes acceptance of the revised Terms.
12. Termination LoanBud may suspend or terminate your access to the Site at any time, with or without cause, and without liability.
13. Governing Law & Venue These Terms and any dispute arising from or related to them are governed by the laws of the State of New York, without regard to conflict-of-law rules. You consent to exclusive jurisdiction in the state or federal courts located in New York County, New York.
14. Severability If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
15. Entire Agreement These Terms, together with any additional agreements or policies referenced herein, constitute the entire agreement between you and LoanBud regarding the Site.
